Family Violence and Tenancy

If you are experiencing family violence and are staying in a rental property, here are some important considerations for you:

 

I would like to stay on in the property. If you want to stay on in the property, you may wish to:

  • You can change the locks in the rental property without the landlord’s consent if the external door and window lock is not part of a master key system where one master key can open many locks. If it is part of the master key system, then you may need an intervention order or check with the property agent/landlord whether the key is part of a master key system.

 

  • To make safety modifications to the rental property, you can install security lights, alarm systems and security cameras that are not hard wired and easy to remove. You can also install non-permanent window film to increase privacy and a lock on the letterbox without needing the landlord’s consent.

 

  • Check the rental agreement to ensure that you can stay. If you are already on the rental agreement and the person threatening you or abusing you is not, then you do not need to change the rental agreement. However, if the person threatening you or abusing you is on the rental agreement you may apply to Victorian Civil and Administrative Tribunal (VCAT) to change the rental agreement.   • That you may need a family violence intervention order to terminate the lease. See information here and then apply to VCAT to terminate the lease. Do not return the keys to the agent prematurely as you may be required to pay for breaking the lease early.
